How has the Canadian Charter of Rights and Freedoms been used to achieve equity and justice for people with disabilities in Canada? This is the question addressed by a recent publication of a long-standing project of the CDPA, and the work of several partners and students. The paper examines the 14 cases heard by the Supreme Court of Canada where a person with a disability sought freedom from discrimination under Section 15 of the Charter. It focuses on 5 seminal cases (Rodriguez,1993; Eaton, 1997; Eldridge, 1997; Granovsky, 2000; Martin & Laseur, 2003), and on the development of disability consciousness among the judiciary.
